$4.5 Million Jury Verdict for Failure to Timely Diagnose Choriocarcinoma

Blume Forte secured a jury verdict in an Atlantic County wrongful death case on behalf of a 25-year-old woman who died from choriocarcinoma, an aggressive but typically curable pregnancy-related cancer. The plaintiff alleged that three OB-GYNs misdiagnosed her bleeding as a miscarriage, failed to examine her or consider other causes, and delayed diagnosis by a month, allowing the cancer to spread. Despite extensive treatment, the woman died, leaving behind a 1.5-year-old child.

$3.5 Million Recovery for Failure to Diagnose Breast Cancer

A $3.5 million settlement was obtained for a 28-year-old woman whose doctors failed to timely diagnose her breast cancer after repeatedly misdiagnosing a breast lump as cystic breast disease. Appropriate testing, including mammography and biopsy, was not ordered, delaying diagnosis until the cancer had advanced and significantly reduced her chances of full recovery.

$2.2 Million Recovery for Delayed Breast Cancer Diagnosis

This case resulted in a $2.2 million recovery during trial for a woman whose breast cancer was not timely diagnosed after mammograms were misread over multiple years. Earlier imaging revealed increasing microcalcifications that were not properly identified or communicated, delaying diagnosis until the cancer had advanced and significantly reducing her chances of survival.

$2.0 Million Settlement for Failure to Diagnose Lung Cancer

Blume Forte secured a $2 million settlement in a failure-to-diagnose lung cancer case involving a woman with scleroderma. A lung lesion seen on CT was mistakenly assumed to be related to her autoimmune disease, and recommended follow-up and biopsy were not performed, delaying diagnosis by 18 months. The cancer was ultimately fatal, despite defense claims that her prognosis was poor regardless of the delay.

What does delay in diagnosis of cancer and failure to diagnose cancer mean?

A delay in diagnosis of cancer occurs when the cancer could have been detected at an earlier stage, and a physician or other healthcare provider failed to timely perform a test, or, perform another procedure, like a biopsy, that could have resulted in an early diagnosis. The failure to diagnose is also a form of medical negligence that results when a physician or other medical provider fails to properly diagnose a patient, based upon symptoms, complaints and test results that consequently prolongs the diagnosis of a patient’s actual cancer. In both cases, the patient may be harmed as a result of being diagnosed at a later stage, which often carries with it more invasive and complex treatment, and possibly a worse prognosis.

How can cancer misdiagnosis affect me?

Cancer is an aggressive affliction that can quickly spread throughout the human body by contact with other tissue and organs, and through the blood and lymphatic system. Did my doctors do everything that the Standards of Medical Care required to detect my cancer?

First of all, it is important that physicians ask the proper preliminary questions, such as those pertaining to medical history and lifestyle habits (e.g., whether or not you smoke or are you exposed to other potentially harmful carcinogens). The most serious potential causes of a patient’s symptoms and complaints, such as cancer, must be considered first by the doctor in coming up with his/her differential diagnosis. Finally, it is important that your physician treats your potential for possibly having a malignancy with the utmost efficiency in order to come to a quick and accurate conclusion regarding your diagnosis.

I was diagnosed with cancer, but my diagnosis came at a late stage in the cancer’s progression. Did medical malpractice prevent me from receiving treatment sooner?
